What is the 2026 Tobacco and Vapes Act?

The Tobacco and Vapes Act 2026 sets out a new legal framework for tobacco, vaping, and nicotine products in the UK. Although it became law in April 2026, the changes will be introduced in stages.

The main goal is to create the UK’s first smoke-free generation. The Act aims to achieve this by making it illegal to sell tobacco products to anyone born on or after 1 January 2009 in the UK. This part of the law is expected to come into force from 1 January 2027.

The Act also gives the government more power to regulate vaping products, including how they’re advertised, packaged, displayed, and sold. This includes products like vape kits, e-liquids, nicotine pouches, and other nicotine alternatives.

It’s important to note that this isn’t a ban on vaping for adults. Adults will still be able to buy legal products, and vaping will continue to play an important role for smokers looking to switch away from cigarettes.

When did the Tobacco and Vapes Bill become law?

The Tobacco and Vapes Bill became law on 29 April 2026, when it received Royal Assent. Now that it has become law, it is officially known as the Tobacco and Vapes Act 2026.

Not every measure starts straight away. Some rules are expected to come into force later in 2026, while the smoke-free generation tobacco rules are set to begin from 1 January 2027.

As with many new laws, further details are likely to be confirmed through guidance and consultations, especially on areas such as vape flavours, packaging, retail licensing, and display rules.

Why has the Tobacco and Vapes Act been introduced?

The government says the Act has been introduced to reduce smoking rates, protect children from nicotine addiction, and make it harder for young people to access tobacco and vaping products. It also supports the government’s wider 10 Year Health Plan, which focuses on preventing health issues earlier and reducing pressure on the NHS.

The Act comes at a time when UK vaping laws are already changing, following the disposable vape ban in June 2025 and ahead of the new vape tax coming in October 2026. While these are separate changes, together they show that tobacco and vaping products are becoming more tightly regulated.

The main reasons behind the Act include:

• Creating a smoke-free generation — Smoking remains the leading cause of preventable illness and death in the UK. By stopping future generations from legally being sold tobacco, the government hopes to phase out smoking over time.
• Reducing youth vaping — There has been growing concern about the number of young people trying vapes, especially products with bright packaging, sweet flavours and designs that may appeal to children. Recent figures show that 20% of 11–17-year-olds in the UK have tried vaping, highlighting why the government is looking to tighten the rules around how vaping products are marketed and sold.
• Tackling illegal and underage sales — The Act gives enforcement teams more power to take action against retailers who sell to under-18s or supply illegal products.
• Improving product regulation — The government will be able to introduce tighter rules around vape packaging, flavours, displays, advertising, and product standards.

This is especially important as, while nicotine vaping isn’t completely harmless, the NHS states that it’s much less harmful than smoking. Chris adds: “Vaping helps adult smokers transition away from cigarettes when products remain accessible, regulated and clearly positioned as better alternatives. If regulation becomes too restrictive, there’s a risk that some consumers may turn to unregulated or illicit sources, which could compromise both safety and product quality.”

What are the new tobacco and vape rules?

The Tobacco and Vapes Act 2026 introduces several new rules, including:

• A smoke-free generation — From 1 January 2027, it will be illegal to sell tobacco products to anyone born on or after 1 January 2009. This means smoking will be gradually phased out over time, rather than banned outright.
• Stricter rules on vaping — The Act gives the government more power to regulate how vapes and other nicotine products are sold, displayed, advertised, and packaged, with a strong focus on reducing youth access.
• An 18+ age limit for non-nicotine vapes — Non-nicotine vapes will also be age-restricted, closing a loophole that previously allowed some vape-style products to be sold without the same controls.
• A ban on vape vending machines — Vape vending machines will be banned because they can’t reliably verify a person’s age.
• A ban on free vape samples — Businesses won’t be able to hand out free vaping products or samples, such as at events, concerts, or in public spaces.
• A retail licensing scheme — Retailers selling tobacco, vapes, and nicotine products may need a licence in the future. This is designed to make enforcement easier and help tackle businesses that break the rules.
• Stronger penalties for illegal sales — Retailers who sell to under-18s, supply illegal products, or repeatedly break the rules could face tougher penalties, including the possible loss of their licence.
• Expanded smoke-free and vape-free areas — The Act gives the government powers to extend smoke-free rules to some outdoor areas, such as near schools, hospitals, and playgrounds. It also opens the door to new vape-free rules in certain public or hospitality settings.
• Controls on vape marketing and sponsorship — Vape brands may face tighter restrictions on advertising, promotions, and sponsorship, bringing the rules closer to those already in place for tobacco.
• Potential restrictions on flavours, packaging, and displays — The government will be able to introduce tighter rules around e-liquid flavours, packaging and how products are displayed in shops, especially where products are considered appealing to children.

Are vapes being banned under the Act?

No, the Tobacco and Vapes Act does not ban vaping for adults — legal vape products will still be available to adult vapers in the UK.

However, the Act does introduce stricter rules around vaping, including a ban on free samples and vending machines, as well as stronger age restrictions. These measures are mainly designed to reduce underage access, while giving the government powers to introduce further rules around how vape products are marketed, packaged, and displayed.

So, while vapes will continue to be available for adults, the way products are sold and promoted may change.

What are the concerns around the Tobacco and Vapes Act? 

While the Tobacco and Vapes Act has been introduced with public health goals, there are some concerns around how the new rules could affect adult smokers, vapers, and responsible retailers.

• Reduced access for adult smokers — Vaping plays an important role in helping adult smokers move away from cigarettes. If regulation becomes too restrictive, there is a risk that some smokers may find it harder to access legal, regulated alternatives.
• Less appeal for adult vapers — Potential restrictions around flavours could make vaping less attractive to adult smokers looking to switch. The government’s concern is that sweet and fruity flavours may appeal to young people and contribute to youth vaping. However, flavours play an important role for adults quitting smoking, with fruit e-liquids by far the most popular flavour in 2025, chosen by 51% of vapers over options like tobacco and menthol.
• More pressure on retailers — “The Act introduces a more demanding compliance environment, increasing operational costs and complexity, particularly for independent retailers,” explains Chris. “While responsible businesses will adapt, there is a risk of accelerated market consolidation. Supporting compliant operators and maintaining a focus on quality, safety, and transparency is now even more important.”
• Growth of the illegal market — If legal products become harder to access, more consumers may turn to unregulated or illicit sources.
• Inconsistent enforcement — If responsible retailers follow the rules but illegal sellers continue operating, it could put legitimate businesses at a disadvantage.
